Bhaskarrao & Ors vs State of Maharashtra

Bench: 2 — N.V. Ramana

In Brief

A group of 14 accused were acquitted by a trial court of charges relating to the death of Shamrao, allegedly killed in a brutal assault. The High Court reversed this acquittal and convicted them under IPC sections 147, 148, 452/149, 302/149, and 506. The Supreme Court reinstated the acquittal, holding that the High Court had improperly re-appreciated the evidence without identifying manifest illegality or perverse reasoning. The Court found material contradictions in prosecution witnesses' statements, gaps between the FIR and trial evidence, absence of bloodstains on weapons, inconsistent medical findings, and lack of independent corroboration, rendering the case unproven beyond reasonable doubt."
