The petitioner applied for compassionate appointment as an Assistant Teacher following the death of his mother, a serving teacher. The State's Selection Committee rejected his application, citing lack of NCTE qualifications. The Court held that the Committee failed to consider the Office Memorandum dated 16.05.2012, which permits compassionate appointments for those with graduate qualifications (for upper primary classes) or even conditionally for those without full qualifications if they undertake to acquire them within five years. The Court remanded the matter for fresh consideration with reasoned application of the Office Memorandum's provisions."
