Coal India Limited appealed against orders granting notional seniority and promotion benefits to an employee transferred to a subsidiary company at his own request. The employee had completed the requisite service period in the parent company before transfer but was denied promotion consideration. The Court held that whilst seniority is reset upon personal inter-company transfer, the employee's prior service must count towards determining promotion eligibility. Seniority and length of service are distinct factors; forfeiture applies only to seniority position, not to recognition of total service for promotion purposes. The appeals were dismissed.
