In Brief
The Supreme Court examined whether conversion of imported logs into sawn timber disqualifies importers from claiming refund of additional customs duty under a 2007 exemption notification. The Revenue contended that goods must be sold in their original form. The Court held that conversion to sawn timber without loss of the product's identity does not forfeit exemption benefits. Since reducing log sizes was necessary for transport compliance with State regulations, the Court affirmed lower courts' decisions allowing the refund claim. All appeals by the Revenue were dismissed.
