The appellant, Digi Cable Network, was granted permission in 2012 to operate as a Multi-System Operator under Rule 11C of the Cable Television Network (Amendment) Rules, 2012. The permission was cancelled in 2014 because the Ministry of Home Affairs denied security clearance. The appellant challenged the cancellation before the High Court, which upheld it. The Supreme Court dismissed the appeal, holding that Rule 11C makes security clearance a mandatory requirement for permission. The Court ruled that in national security matters, prior notice and hearing are not required, as such decisions are executive matters of policy, not law. The appellant may apply for fresh permission.
