EX.LAC YOGESH PATHANIA vs UNION OF INDIA

Bench: 2 — Dhananjaya Y. Chandrachud, Hemant Gupta

In Brief

Ex-LAC Yogesh Pathania appealed a District Court Martial conviction for insubordinate language to a senior officer, use of criminal force against a warrant officer, and conduct prejudicial to Air Force discipline, arising from an incident in 2009. The Armed Forces Tribunal upheld the conviction. Pathania sought leave to appeal to the Supreme Court. The Court held that under the Armed Forces Tribunal Act, 2007, appellate jurisdiction exists only for points of law of general public importance. Finding no such point of law involved and the Tribunal's view being plausible on the facts, the Court dismissed the appeal and denied leave to appeal."
