Gangappa and Fakkirappa dispute agreements to sell allegedly not properly stamped under the Karnataka Stamp Act, 1957. The trial court admitted the documents on payment of deficit stamp duty plus a penalty of twice the shortfall. The High Court mandated a 10-fold penalty instead. The Supreme Court held that while courts admitting insufficiently stamped documents must impose a mandatory 10-fold penalty under Section 34, the Deputy Commissioner may later refund excess penalties under Section 38. To avoid prolonging already-delayed proceedings, the Court confirmed the trial court's lower (double) penalty as just, given the parties' status as illiterate agriculturalists whose documents were improperly prepared.
