A landlord sought to evict his tenant from a portion of his house citing his bona fide need for residence. The tenant claimed that the landlord-tenant relationship had ended following an earlier unregistered agreement to sell the property. The Supreme Court held that a mere agreement to sell a tenanted property does not automatically terminate the landlord-tenant relationship unless the agreement expressly or impliedly shows the parties' intention to surrender the tenancy under the Transfer of Property Act. The court distinguished prior precedent and found no such intention in the agreement's terms. The tenant was not entitled to claim part performance under an unregistered agreement. The eviction application was properly allowed on grounds of the landlord's bona fide residential need.
