An insurance company appealed against a Motor Accident Claims Tribunal award, contending the tribunal wrongly found the insured vehicle caused a fatal accident. The Supreme Court issued notice to the respondents and partially allowed the appeal by granting a stay on execution pending final decision. The insurance company was directed to deposit the award amount within six weeks. Upon deposit, 50% would be held in a fixed deposit for one year while 25% each went to the deceased's wife and mother, subject to an undertaking that all amounts would be refunded if the appeal succeeded in the insurer's favour.
