IQ City Foundation & Anr vs Union of India & Ors

Bench: 3 — Dipak Misra

In Brief

IQ City Medical College sought renewal of permission to admit MBBS students for the academic year 2017-18. After initial assessment and a Hearing Committee found deficiencies remediable, the Central Government remanded the matter for compliance verification. The MCI conducted a fresh inspection revealing faculty deficiency of 15.9% and resident doctor deficiency of 25.88%—both far exceeding the 5% limit. The Hearing Committee found these incompatible with MCI guidelines and recommended non-renewal. The Supreme Court upheld the denial for 2017-18, holding that remand orders to the MCI are not limited in scope. However, the Court permitted the college to apply afresh for 2018-19 without prejudice.
