Jamila Begum (D) Thr. Lrs vs Shami Mohd. (D) Thr. Lrs. & Another

Bench: 2 — R. Banumathi

In Brief

Wali Mohd. executed a mortgage deed (1967) and later sold a house to Jamila Begum for Rs. 30,000 (1970). His son, Shami Mohd., sued claiming an oral gift from his father and seeking cancellation of both documents. The trial court upheld the sale deed as valid and registered. The first appellate court and High Court reversed, accepting the oral gift claim and granting redemption rights. The Supreme Court allowed the appeal, holding: (1) registered documents presume valid execution; (2) oral gift lacked proof of possession delivery; (3) undue influence was not established; (4) the suit was time-barred (filed 1978, beyond three years); (5) the High Court wrongly decreed redemption without following proper procedure. The trial court's judgment was affirmed and the suit dismissed."}
