A Mumbai-based NGO challenged the Development Control Regulations permitting developers to increase density (Floor Space Index from 1 to 2) in specified zones using Transferable Development Rights to finance slum rehabilitation. The Supreme Court dismissed the appeal, holding that absent patent illegality or constitutional violation, courts cannot interfere with development and zoning policies formulated by elected governments through consultative processes. Local matters are best handled by state courts and local authorities. The TDR policy, having statutory basis and periodic review mechanisms, did not violate constitutional guarantees.
