The appellant, appointed as an untrained teacher in 1994, later acquired her B.Ed qualification in September 1997 and became a trained teacher. The 5th respondent was appointed as a trained teacher (holding B.A. and B.Ed) in August 1997, shortly before the appellant obtained her qualification. Under the Maharashtra Employees of Private Schools Rules, 1981, secondary school teachers are categorized in Schedule F, with seniority determined by when they enter their respective category. The Supreme Court held that the appellant could not claim seniority over the 5th respondent in the trained teacher category merely because she was appointed earlier as an untrained teacher. The 5th respondent entered the trained category before the appellant, making him senior. The appeal was dismissed."
