The appellant was convicted under Kerala Abkari Act Sections 8(2) and 63 for illegal possession of 4.5 litres of arrack and 3.750 litres of Indian Made Foreign Liquor found during a search of his home. The trial court sentenced him to one year simple imprisonment and a fine of Rs. 1,00,000; the High Court reduced imprisonment to nine months. The Supreme Court partly allowed the appeal, further reducing the imprisonment term to the 35 days already undergone in custody while confirming all penalties, finding such reduction served the interests of justice.
