M.K. Jain (dead) thr. Lrs vs Principal Secretary, State of Uttar Pradesh & Ors

Bench: 2 — Kurian

In Brief

An employee of a Nigam (state undertaking) who was terminated was deceased by the time his appeal reached the Supreme Court. The Court upheld the inquiry findings supporting the termination, but noting the Nigam had been wound up and employees absorbed into the State, directed the State to audit all dues owed to the deceased employee (including subsistence during suspension). The Court ordered payment to his legal heirs with 18% annual interest. The appeal was disposed of with directions for verification and payment compliance.
