In Brief
Two companies disputed unpaid dues for goods supplied. After the buyer was declared sick and placed under a special acquisition act, the supplier filed a claim for unpaid bills and interest. The Commissioner awarded only the principal amount. The Supreme Court held that appeals under the special act are not governed by the general Limitation Act (Article 116), as the statute expressly restricts Code applicability to specific provisions only. Without prescribed limitation, appeals must be filed within reasonable time judged by case circumstances. The 3-year delay here, with intervening remedial attempts, was reasonable. The appeal was allowed and remitted to the District Judge for fresh consideration.
