Mahesh Dube's father was unlawfully dispossessed of his house by the respondents and their father through criminal trespass and force. The Trial Court convicted the accused under Section 448 IPC and ordered restoration of possession. After the appeal was dismissed, the appellant sought to enforce this order beyond 30 days. The Trial Court rejected the application citing the 30-day limit under Section 456(1) Cr.P.C. The Supreme Court held that the 30-day limit applies only when no order was passed at conviction. Since the Trial Court had already ordered restoration, the subsequent enforcement was not time-barred. The appeal was allowed and the respondents were directed to hand over possession within one month.
