The appellant, an electricity consumer, was charged under Section 135 of the Electricity Act, 2003 for alleged theft of electricity after BSES Rajdhani Power Limited issued a bill for Rs. 3,54,598.21. The parties settled their dispute in a Lok Adalat on 11.02.2018 for Rs. 1,60,000, with BSES agreeing to withdraw all cases. When the High Court dismissed the appellant's petition to quash the FIR, the Supreme Court allowed the appeal and remanded the case for reconsideration in light of Section 152 of the Electricity Act, 2003, which governs compounding of offences under the Act.
