Paresh Nath Samanta vs State of West Bengal & Ors

Bench: 1 — Jay Sengupta

In Brief

A retired security officer challenged a statutory corporation's rejection of his claims for interest on delayed retiral benefits and refund of amounts deducted post-retirement. The court held that employees are entitled to interest on all retiral dues delayed without their fault, regardless of whether paid in tranches. Following the precedent in State of Punjab v. Rafiq Masih, the court ruled that no deductions can be made from retiral benefits after superannuation, even for alleged overpayment. The corporation was directed to refund deducted amounts with 7% interest from the deduction date and pay interest on the earlier 60% payment tranche, all within one month."
