A property was auctioned following a labour court judgment awarding dues to workmen. The highest bidder, Sachdeva, purchased the land for Rs. 70 lakhs. Only Alok Mitra filed objections to the sale (not the other private respondents), which were not communicated to the District Magistrate in time. The District Magistrate confirmed the sale. Mitra later withdrew his objections. The private respondents subsequently accepted the excess amount (Rs. 14 lakhs) over their dues from the sale. The Supreme Court held the private respondents waived their rights by accepting the sale's benefits and taking inconsistent positions, and the High Court erred in setting aside the confirmed auction sale."
