A person with benchmark disability sought a writ to obtain 4% reservation and out-of-turn promotion to the post of Scale-I Officer in a national insurance company. The Supreme Court held that Section 34 of the Rights of Persons with Disabilities Act, 2016 provides for 4% reservation in recruitment only, not promotion. Since no circular had been issued by the Central Government providing for reservation in promotion for disabled candidates, the petitioner's claim was not sustainable. The writ petition was dismissed as wholly frivolous."
