Petitioners sought relief identical to that granted in an earlier case (Om Prakash) involving the same recruitment process for Rajasthan Educational Subordinate Service. The Court held that where candidates are selected from a common merit list and appointed in different batches, seniority must follow inter-se merit order, regardless of appointment timing. Candidates ranked higher in merit cannot be placed below those appointed later but ranked lower. Since similarly situated petitioners raised the same issue, the Court disposed of their petition consistently with the prior decision, applying the principle that statutory rules governing seniority must be applied uniformly according to merit.
