Rahul Subhash was charged under Section 55(a) of the Abkari Act for possession of 750 ML of foreign liquor found during a house search following his arrest in an unrelated NDPS case. The liquor was allegedly brought from another state and not intended for sale in Kerala. The Court allowed his bail application, finding that the facts and nature of the allegation warranted discretionary release. The petitioner was required to furnish a bond of Rs. 50,000 with two sureties and to comply with conditions including non-interference with investigation and no commission of further offences."
