Three accused persons sought pre-arrest bail in connection with allegations of gang rape, dacoity, and burning a house during a home invasion. The informant alleged that the three named accused, along with four unknown persons, forcibly entered her home in the absence of her husband, raped her, looted cash and ornaments, and set the kitchen on fire. The Supreme Court examined the case diary and found sufficient incriminating materials, including independent witness corroboration and the informant's statement under Section 164, CrPC. The Court held that the gravity of the allegations and the strength of evidence rendered this unsuitable for pre-arrest bail and rejected the application.
