Shrikant vs Narayan Singh (Dead) Thr. Lrs. & Ors

Bench: 2 — Banumathi

In Brief

A landlord sought eviction of a tenant and recovery of rent. The Trial Court found a landlord-tenant relationship existed and decreed the suit. The First Appellate Court reversed, finding no landlord-tenant relationship but upholding the termination notice. The High Court, in a second appeal, had framed two substantial questions of law regarding the landlord's title and rejection of the tenancy document. However, instead of answering these questions, the High Court examined the validity of the quit notice—an issue not framed as a question of law. The Supreme Court held the High Court should have addressed only the framed questions and remitted the matter for reconsideration."
