Sk. Khabir and five others were convicted for murder, attempted murder, and unlawful assembly after they attacked the complainant and his brothers on 25 April 1981. The attack resulted in the deaths of the complainant's two brothers and injuries to the complainant himself. The trial court and High Court upheld the convictions. On appeal, the Supreme Court affirmed both lower courts' decisions, finding the eye witness testimony fully corroborated by medical evidence of injuries from weapons like swords and lathis. The Court noted the accused did not challenge the post-mortem reports, further supporting the conviction. The appeal was dismissed.
