STATE OF UTTARAKHAND vs RAJ KUMAR

Bench: 2 — Abhay Manohar Sapre, Indu Malhotra

In Brief

A daily-wage worker employed by Uttarakhand PWD for about one year (1986–1987) filed a dispute 25 years after termination, claiming reinstatement. The Labour Court awarded ₹30,000 compensation; the High Court directed reinstatement without back wages. The Supreme Court held that for a daily-wage worker with only procedural illegality (non-payment of statutory notice), no right to regularization, and delay of 25 years, monetary compensation is appropriate rather than reinstatement. The Court enhanced compensation from ₹30,000 to ₹1,00,000 under Section 11-A and dismissed the High Court's reinstatement order.
