Sunita Devi and Anr vs Union of India and Ors

Bench: 2 — S. Abdul Nazeer

In Brief

This case involved petitions to re-investigate two related murder cases in Uttar Pradesh: the 2001 death of Seema Garg and her children, and the 2002 death of Nitin Garg. The trial court in the first case found the investigation was conducted improperly. The Supreme Court refused to order re-investigation of the second case, as acquittals had been affirmed by the High Court and appeals rejected. However, for the first case, the Court constituted a Special Investigating Team (SIT) headed by a retired CBI officer to conduct a fair and independent re-investigation, directing completion within three months with full government support and resources.
