SUNITA DEVI vs UNION OF INDIA AND ORS. MINISTRY OF HOME AFFAIRS SECRETARY

Bench: 3 — A.K. Sikri, S. Abdul Nazeer, M.R. Shah

In Brief

Sunita Devi sought court-monitored re-investigation into the 2001 murder of her daughter-in-law Seema Garg and two grandchildren, after the accused were acquitted by the trial court which observed the investigation was conducted improperly. The Supreme Court constituted a Special Investigating Team (SIT) to re-investigate. The SIT concluded the accused were involved at the behest of the victim's husband. The Court held that the CBI must examine the SIT's report and findings and take appropriate action in the interest of justice. The writ petition was disposed accordingly.
