The State of Haryana challenged a High Court order granting promotion to Classical & Vernacular (C&V) Teachers to the post of Elementary School Headmaster. The Court held that Rule 9(5) of the 2012 School Service Rules, which 'converts' C&V Teachers to TGT status, does not make them members of the TGT cadre eligible for such promotion. The conversion is merely notional, to prevent C&V Teachers from being ungoverned when the 1998 Rules were replaced. Only Masters appointed under the 1998 Rules qualify as TGTs under the 2012 Rules. C&V Teachers, as a declining feeder cadre, cannot be treated at par with the TGT promotional cadre. The Appeal was allowed and the High Court order was set aside.
