This appeal challenges a High Court order that dismissed a partition suit's second appeal in limine, holding it did not raise substantial questions of law. The appellants, claiming ancestral land and family membership, had sued for partition. The trial court decreed their suit, but the first appellate court reversed it, relying on document EX-A. The Supreme Court held that interpretation of documents, their admissibility, and effect on parties' rights constitute substantial questions of law under Section 100 of the CPC. Since both lower courts relied on EX-A to decide the case, the High Court should have admitted the appeal on merits rather than dismissing it in limine. The appeal was allowed and remanded to the High Court for decision on the framed substantial questions of law.
