In Brief
This appeal challenged a Motor Accident Claims Tribunal's award of compensation totalling Rs. 33,01,000 to families of two persons who died in a motorcycle-vehicle collision on 17 December 2015. The insurer argued the insured vehicle was wrongly implicated and the eyewitness testimony was unreliable. The Supreme Court upheld the Tribunal's findings, holding that the eyewitness (AW-2) Jetharam clearly testified to the accident and the insured vehicle's involvement, and that cross-examination did not materially discredit his evidence beyond a general suggestion he was lying. The Court found no substance in the appeal and dismissed it, affirming the compensation award.
