Wazir & Anr vs State of Haryana

Bench: 2 — Uday Umesh Lalit

In Brief

The Supreme Court determined compensation for approximately 1,500 acres acquired across six villages for an Industrial Model Township in Haryana. Recognizing significant differences in historical land values between villages, the Court adopted a differentiated approach: Rs 37.54 lakhs per acre for premium villages (Naharpur Kasan, Kasan), Rs 28.77 lakhs per acre for lower-valued villages (Bas Kusla, Bas Haria, Dhana), and Rs 56.31 lakhs per acre for Manesar (abutting a national highway). The Court rejected severance charges claimed by one landowner, holding that acquisition merely enhancing surrounding land value does not justify additional compensation. The State's appeals were partly allowed and landowners' appeals dismissed.
