The Supreme Court of India is scheduled to pronounce its decision on the bail applications filed by several accused persons in the alleged larger conspiracy linked to the 2020 North-East Delhi riots. The matters concern, among others, Umar Khalid, Sharjeel Imam, and co-accused who have been in judicial custody for an extended period.
A Division Bench of the Supreme Court had earlier reserved its order after hearing detailed submissions from both sides. The accused persons have challenged the orders of the Delhi High Court rejecting their bail pleas in cases registered under the Unlawful Activities (Prevention) Act, along with provisions of the Indian Penal Code.
During the course of arguments, the defence highlighted prolonged incarceration, delay in commencement of trial, and absence of direct involvement in acts of violence. On the other hand, the prosecution opposed the grant of bail, asserting that the allegations disclose a coordinated and pre-planned conspiracy, attracting the rigours of special anti-terror legislation.
The outcome of the Supreme Court’s decision is expected to have significant implications on the interpretation of bail standards under the UAPA, particularly in cases involving long periods of custody and pending trials.
The verdict is awaited and will determine whether the accused will be released on bail or continue in judicial custody during the pendency of trial proceedings.
