The suit arises from a social media post in which Singh allegedly attributed certain statements to Golwalkar relating to social and religious issues. The plaintiff, an RSS member, has claimed that the remarks were false and defamatory and had the effect of harming the reputation of Golwalkar and the organisation.
Rejecting Singh’s application seeking dismissal of the case at the threshold, the court held that the plaint disclosed sufficient grounds to proceed with the suit. It also declined to accept objections regarding jurisdiction, valuation, and the plaintiff’s right to sue.
