Delhi Excise Policy Scam: Supreme Court denies relief to K Kavitha and says approach the trial court for bail

Today, the Supreme Court (SC) of India refused to grant relief to the Bharat Rashtra Samithi leader and daughter of former Telangana Chief Minister K Chandrashekhar Rao, K Kavitha who was arrested in a money laundering case related to the Delhi Excise Policy Scam case. The three-judge bench of the SC, Justice Sanjiv Khanna, Justice Bela M Trivedi, and Justice MM Sundresh was hearing a writ petition filed by K Kavitha against her arrest by the Enforcement Directorate (ED). The bench issued a notice to the ED and asked K Kavitha to approach the trial court for bail. It told Senior Advocate Kapil Sibal appearing for Kavitha, “On all matters if under Article 32 they seek bail…You cannot argue on merits. We have to be uniform. We can issue a notice in the main plea about the constitutional challenge and keep it later.” The notice was issued against PMLA provisions and the bench tagged the matter along with the petitions seeking review of the Vijay Madanlal judgment. It said, “Do not get emotional. This will take time. Vijay Madanlal review we are hearing. Regarding bail, you have to go to the trial court.”
