Supreme Court: Interveners to follow independent remedies for purchasing Ayurvedic Medicines

The decision by the Allahabad High Court regarding the purchase of Ayurvedic medicines issued by UP in favor of IMPCL (Indian Medicines Pharmaceutical Corporation Limited) was challenged by the Kerala Ayurvedic Co-operative Society Limited through a writ petition. This petition was allowed by the High Court and directed that after inviting tenders, Ayurvedic medicines must be purchased by adopting an appropriate transparent process. The issue raised was in context with the operating guidelines of the National AYUSH Mission, procuring Ayurvedic drugs for the state from IMPCL without inviting tenders. This issue was further addressed by the Supreme Court where the intervention applicant prayed that in accordance with the policies of the State and the Central Government, a minimum percent of Ayurvedic drugs must be procured from MSMEs. This was beyond the scope of Special Leave Petition and interveners would follow their own intermediate remedies according to the law.
