Harsh Dev Thakur’s financial fraud case: Supreme Court remarks “Nobody can have luxury in jails” and dismisses the temporary bail plea

Today, the Supreme Court of India while hearing a plea seeking temporary bail for Harsh Dev Thakur in a case of financial fraud remarked that “Nobody can have luxury in jails”. The comment was passed by the top Court when the counsel appearing for the petitioner argued that the petitioner was not in luxury in jail. The bench dismissed the petition. The Respondent’s counsel argued that the petitioner diverted over Rs. 2.5 crores. To this, the petitioner’s counsel said that “From inside, I can’t arrange such funds. All my assets including access to my shares, and mutual funds have been taken…” Along with this, the petitioner’s counsel also submitted that the trial was not progressing to which the bench ordered for the trial to be expedited. Further, a request was made by the petitioner regarding the time frame within which the trial would be completed, and the bench observed, “We can’t give a time frame.” Lastly, the Supreme Court allowed the petitioner to move to the High Court stating, “We grant him permission to file for temporary bail if trial not completed within a reasonable time.”
