For an existing FIR (Crime No. 589/2024, Nunna PS, Vijayawada), please guide me on the procedure and format for a Section 173(4) BNSS representation before approaching the Magistrate under Section 175(3), if possible. 2. Is an affidavit mandatory with the 173(4) representation 3. Since our case is under the Vijayawada City Police Commissionerate, should the 173(4) representation be addressed to the Commissioner of Police, and how should we ensure it satisfies the statutory requirement? 4. We are facing difficulty submitting representations personally. At the CP/ACP/other offices, lower-level police personnel (ASI) are sometimes refusing access (They all are Nunna PS Writer ASI batchmates) and we are unable to meet senior officers. What is the legally safest method of submission — Speed Post/Registered Post, official email, physical inward submission, or all three? 5. If we send the representation by Speed Post and official email, what proof of service/submission should we preserve so that it can later be produced before the Magistrate under Section 175(3)? 6. Please also advise what documents should be attached to the 173(4) representation and whether we should submit the entire PGRS history along with the important documents, including the DCP directions, saree-programme circumstances pictures and FIR discrepancies. 7. Finally, if the superior police authority does not take effective action after this representation, how long should we reasonably wait before filing the 175(3) application, and what documents should be annexed to prove compliance with Section 173(4)? We are unable to afford a private advocate, when we approached NALSA, they assigned to APSLSA, but they rejected by saying not in our ambit. Police filed a chargesheet against me under section 85 BNS,3,4 DPA. I asked for a chargesheet copy from police and they rejected it. I filed RTI and police rejected it.
