Section 269 BNSS Newly added The newly added subsection (7) provides that if the attendance of the prosecution witnesses under sub - sections (5) and (6) cannot be secured for cross - examination, it shall be deemed that such witness has not been examined for not being available and Magistrate proceed further .

Section 246 of the Code of Criminal Procedure, 1973 deals with procedure where accused is Not discharged. Under the new law this is Section 269 of the BNSS.
