About Section 45 BNS
Section 45 of the Bharatiya Nyaya Sanhita, 2023 (BNS) defines abetment - the foundation on which liability is fixed on people who did not commit an offence with their own hands but instigated it, plotted it or helped it happen. It is the direct successor of Section 107 IPC , carried into the new code with only a single drafting change. Like its predecessor, it is a definition provision : it says what abetment is, and leaves the punishment to the sections that follow in the same chapter.
