Two branches of a family descended from Tek Chand Khanna disputed ownership of two properties: Kamla Nagar and Malcha Marg. The Kamla Nagar property was purchased in the ancestor's name by Roop Kishore Khanna. After RKK died in 1978, his successors paid Rs. 55,000 to Attar Chand Khanna (RKK's brother) in 1979, allegedly settling ACK's joint family claim. The High Court rejected this settlement; the Supreme Court reversed it, finding the settlement genuine based on actual payment, witness admissions, and ACK's failure to claim any share thereafter. Malcha Marg, registered in ACK's wife's name, was held to be exclusively ACK's family's property, with no evidence of joint family funding.
