A2: SATYANARAIN SAHU A3: vs THE STATE OF JHARKHAND & ANR

Bench: 2 — Sudhanshu Dhulia, Ahsanuddin Amanullah

In Brief

The Supreme Court allowed an appeal challenging the High Court's decision to set aside a Magistrate's order taking cognizance in a case involving allegations of bigamy, harassment, and caste-based abuse under the SC/ST Act. The Court held that a Magistrate's order taking cognizance does not require explicit reasons or detailed disclosure of prima facie material. The Magistrate need only indicate it has applied its mind to the case materials and found sufficient grounds for proceeding. Higher courts should not interfere with valid cognizance orders merely because reasoning is sparse. The determination of guilt is the trial court's function, not the Magistrate's at the cognizance stage.
