Supreme Court of India 2019-12-10 disposed

ABCD vs UNION OF INDIA

Bench: 3 — Uday Umesh Lalit, Indu Malhotra, Krishna Murari

In Brief

The petitioner, a woman alleging rape by an IPS officer, sought transfer of investigation to a Central Agency and police protection. The Supreme Court found investigation by Delhi Police's Special Investigation Team was fair and charge-sheet had been filed. However, the petitioner had falsely claimed a car hit her on 17.10.2019 to insinuate the officer attacked her; CCTV proved a tricycle hit her. The Court ruled that making false sworn statements to the Court constitutes contempt and abuse of process. It dismissed the petition and initiated suo motu contempt proceedings against the petitioner for misleading the Court.
