The Supreme Court upheld the Kerala Administrative Tribunal's decision voiding the regularization of 61 ad hoc promotions of Upper Division Clerks to Executive Officer Grade-I, as these exceeded the eligible quota. Although all 97 original promotions were ad hoc and in excess of quota, and cannot legally be regularized, the Court tempered its ruling: incumbents still serving (found to be not more than two of the 61) shall not be reverted due to decades of service, and those already retired shall retain their pensions. The appeals were dismissed, subject to this relief.
