The appellant, elected to the Kerala Legislative Assembly from Koduvally constituency, challenged an election petition filed against him on grounds of corrupt practices under Section 123(4) of the Representation of People Act. The appellant argued the petition was time-barred because minor defects were cured after the 45-day limitation period. The Supreme Court held that since the petition was presented within the prescribed period, and court-ordered corrections of minor defects did not breach the threshold requirements, the petition was not barred by limitation. The Court also held that non-supply of sealed materials, where transcripts and CDs were provided, did not prejudice the appellant's defence. The appeal was dismissed.
