AG and P LNG Marketing Pte. Ltd and other parties filed appeals before the Appellate Tribunal for Electricity (APTEL) against regulatory orders. After hearing, a difference of opinion arose between the APTEL Chairperson and the Technical Member (Petroleum & Natural Gas). The Chairperson directed the matter be reheared by the Judicial Member, who subsequently recused himself. With no other Judicial Member available, the proceedings deadlocked. The Supreme Court held that under Article 142 of the Constitution, it could withdraw the appeals from APTEL and transfer them to itself to ensure finality, particularly given the infrastructure nature of the dispute and the urgent need for resolution.
