Agyapaul Singh vs State Bank of India (SAMB)

Bench: 2 — Kurian

In Brief

The Supreme Court set aside a High Court order proceeding against an appellant for contempt based on dishonour of a cheque. The Court held that mere non-compliance with a court order does not constitute contempt without proof of willful or deliberate disobedience. The High Court erred in pre-judging contempt and rejecting the appellant's request to file a reply without hearing him. The Court remitted the matter to the High Court to grant the appellant an opportunity to file a reply, hear him, and only then decide whether to proceed with contempt proceedings."
