Air India Express appealed against a high court order that permitted its pilot employee, Capt. Gurdarshan Kaur Sandhu, to withdraw her tendered resignation. The Supreme Court held that while employees ordinarily may withdraw resignations before they take effect, exceptions exist. Where an employer has already invested in recruiting and training a replacement, and the notice period stems from civil aviation regulatory requirements, an employee cannot unilaterally withdraw. The Court upheld the employer's position, allowing the appeal and rejecting the pilot's withdrawal attempt.
