Ajay Singh and Anr and Etc vs State of Chhattisgarh and Anr

Bench: 2 — Dipak Misra

In Brief

The deceased, Ruby Singh, committed suicide at her matrimonial home in 1998, and criminal charges were filed against her husband and in-laws under sections relating to dowry and abetment of suicide. The trial court announced the accused had been acquitted but produced no signed judgment document on record. The High Court cancelled this defective order and transferred the case for retrial. The Supreme Court upheld the High Court's action, holding that a valid judgment must be written, signed, and pronounced in open court under the CrPC; a mere result announcement is insufficient. The High Court had authority under Article 227 to transfer the case to ensure justice system integrity. The Court stressed that justice serves both victims and accused equally."
